Trump is expected to sign legislation Thursday that would allow states to opt out from paying child support.

    The legislation, which is a response to a lawsuit brought by the American Civil Liberties Union, would make the case that child support should be a separate matter from spousal support. 

    “It’s a clear recognition that child abuse is a very real problem in our society and that child welfare services are critical,” Rep. David Cicilline, a Rhode Island Democrat who has introduced the legislation, said on CNN’s State of the Union. 

    Cicilline said he’s working with Democratic lawmakers on the bill to make sure that there’s “flexibility” for states to implement their own child support guidelines.

    “There are certain states that have opted out, but we’re working with our Republican colleagues on this,” he said.

    “We’re also working with the Democratic colleagues on that.”

    Ciciline said the legislation also makes clear that the states that opt out could also opt out if they choose to do so.

    While the bill does not go into details about how states will implement their guidelines, it does indicate that child supports will be paid by the state, not the federal government.

    The bill would also make clear that states that pay child support will also have to pay for certain health care costs related to child support, including maternity and newborn care, dental care, and mental health care.

    According to Cicillines legislation, the bill would make sure “all states have the ability to determine the manner in which a child support payment should be made.”

    Citicillines bill would create a task force to recommend ways to better enforce child support payments.

    The task force is expected in a year or so to issue recommendations on how to make it easier for states and localities to opt-out of child supports enforcement.
